Minimum Arbitration Fees (Administrative fee, Examination fee and Arbitrator fee) is Rp 20.000.000,-

Arbitration Fees (Administrative fee, Examination fee and Arbitrator fee) respectively both for the Claim and Counter-Claim are as follows:

Notes:

1. For claims with a value greater than Rp 1.000.000.000,- and between these figures, the rate calculated by using interpolation.
2. The above fees are paid after BANI issues a billing letter to the parties.
3. The VAT will be added for the abobe fees at the prevailing rate.
4. The above fees apply to every case registered as of 2nd January 2026.

1. The cost of summons, transportation and honorarium of witnesses and/or experts. These fees are borne by the party proposing the witness and/or expert. If witnesses/experts are presented by the Tribunal, the cost are charged to the parties and must be paid in advance to BANI before the witness and/or expert is heard.

2. Transportation costs, accommodation and other costs (if any), for arbitrators residing outside the venue of the hearing. These costs are borne by the party appointing/selecting the arbitrator and determined in amount by the arbitrator concerned and paid to them through BANI.

3. The cost of the hearing which is conducted in a place other than provided by BANI. These costs include the cost of the venue of the hearing, transportation and accommodation when necessary and is the burden of the requesting party or the burden of all of the parties if under the request of the arbitration tribunal.

4. The cost of site visit will be calculated by BANI. The cost is the burden of the parties and will be billed by BANI to the parties.

5. The cost of registering the arbitration award in the District Court.

The fee for an Emergency Arbitration Request is Rp. 200.000.000,- plus VAT in accordance with applicable provisions.

The cost of Binding Opinions is discretely determined by the Chairman of BANI taking into account the complexity of the problem.

1. If the case is dismissed before the hearing begins, the arbitration costs paid will be refunded in the following details:

   1. Returned 100% (one hundred percent) if the revocation is made within 5 (five) days from the time the payment is received by BANI;

   2. Returned 90% (ninety percent) if the revocation is carried out within a period of time between 6 (six) days to 90 (ninety) days from the time payment is received by BANI;

   3. Returned 80% (eighty percent) if the revocation is made within a period of time between 91 (ninety-one) days to 180 (one hundred and eighty) days from the time the payment is received by BANI;

   4. Returned 70% (seventy percent) if the revocation is made more than 180 (one hundred and eighty) days after the payment is received by BANI.

2. If the revocation of the case is carried out after the issuance of the Decision Letter of Arbitration Tribunal Establishment, the Arbitration Fees that have been paid are non-refundable.

3. In the event of the Deletion of the case by the Board of Management of BANI for any reason and the Decision Letter of Arbitration Tribunal Establishment has not been issued, the refund of the arbitration fees that have been paid will be calculated as per the provisions of point 1.

4. If in the proceedings the Arbitration Tribunal or sole arbitrator decides that the tribunal has no authority to examine and decide the case, the Arbitration Fees that have been paid by the parties or either of the parties as a whole are not refunded.
